1. Agreement to Terms
By accessing or using Aperture OS ("the Service"), operated at aperture-os.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Aperture OS is an AI-powered platform that helps business owners discover, design, and plan AI automation workflows through guided conversation. The Service uses multiple specialized AI agents to research your business, identify automation opportunities, extract process details, and generate implementation plans.
3. Account Registration
- You may begin using the Service without an account. Creating an account enables persistent access to your sessions and data.
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate information when creating an account.
- You must be at least 18 years old to use the Service.
4. Subscription and Payment
- Certain features of the Service require a paid subscription.
- Subscriptions are billed monthly through Stripe. By subscribing, you authorize recurring charges to your payment method.
- You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
- We reserve the right to change subscription pricing with 30 days' notice. Price changes apply to the next billing cycle after notice is given.
- Refunds are handled on a case-by-case basis. Contact us if you believe you are entitled to a refund.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable laws
- Attempt to gain unauthorized access to the Service, other accounts, or related systems
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to generate content that is harmful, deceptive, or violates third-party rights
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Scrape, crawl, or use automated means to access the Service without permission
- Share your account credentials with others or allow unauthorized access to your account
6. Your Content
You retain ownership of all information, business data, and content you provide through the Service ("Your Content"). By using the Service, you grant us a limited license to process Your Content as necessary to deliver the Service, including sending it to third-party AI providers for processing.
You are responsible for ensuring that Your Content does not violate any third-party rights or applicable laws. Do not share sensitive personal data (such as Social Security numbers, health records, or financial account credentials) through the conversation interface.
7. AI-Generated Output
The Service generates output using artificial intelligence, including business analysis, workflow recommendations, and implementation plans ("AI Output"). You should understand that:
- AI Output is generated by machine learning models and may contain errors, inaccuracies, or incomplete information.
- AI Output is provided as guidance and should not be treated as professional advice (legal, financial, technical, or otherwise).
- You are responsible for reviewing, validating, and testing any AI Output before implementing it in your business.
- We do not guarantee that AI Output will be accurate, complete, or suitable for your specific situation.
- Implementation plans and integration recommendations should be verified against current documentation for the tools and services referenced.
8. Third-Party Services
The Service integrates with third-party AI providers (Anthropic, Google, OpenAI) and payment processing (Stripe). Your use of these services is subject to their respective terms. Implementation plans generated by the Service may reference third-party tools and platforms; we are not affiliated with and do not warrant the availability or functionality of those tools.
9. Intellectual Property
The Service, including its design, code, AI agent system, prompts, and branding, is owned by Aperture OS and protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding.
AI Output generated specifically for you during your sessions is yours to use for your business purposes.
10. Limitation of Liability
To the maximum extent permitted by law, Aperture OS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the total amount you paid us in the twelve (12) months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
12. Indemnification
You agree to indemnify and hold harmless Aperture OS from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data prior to account deletion.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
